1. Applicability of Terms and Conditions
The following terms and conditions shall govern all contracts between you as a consumer and TopParfumerie eenmanszaak, Bruntingerbrink 82, 7812VB Emmen, the Netherlands. Managing Director: Marianne Havenstein, Registered in the Netherlands, KvK no. 04085959, Emmen. VAT-no. NL103380218B01, (hereinafter referred to as “TopParfumerie”).
 
The applicability of any general terms of the Buyer is hereby expressly rejected.
 
TopParfumerie is an accredited online shop and has agreed to comply to the Trusted Shops quality criteria (available at www.trustedshops.com).
 
 
2. Offer & Acceptance
When you place an order to purchase a product by clicking the order button, we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we send an order confirmation via e-mail to you that we've accepted your order or dispatched the product(s) to you.
 
 
3. Right to Cancel for Consumers
 You have the right to cancel the order at anytime before the expiry of a period of fifteen working days 1 beginning with the day after the day on which you receive the goods without giving reason. However, this period won’t start before all information obligations laid down in the „Consumer Protection (Distance Selling) Regulations 2000“ have been fulfilled. You may cancel by giving us notice in any of the following ways: by a notice in writing which you leave at our address, by a notice in writing which you send by post to our address, by fax to our business fax number, by email to our email address.

Consequences of Withdrawal
You must return any goods supplied at your own expense if you cancel the contract. You have to be reimbursed for all amounts you have paid within thirty days after the supplier has received your notice of withdrawal.
 
Specific indications
When you sent us the whole or partitial order in a deteriorated state for a refund you must, where appropriate, perform value replacement.

 
 
 
4. Prices and delivery costs
4.1 All prices are in EUR and include 19% VAT at the appropriate rate. Delivery charges are not included in the prices quoted.
4.2 For orders within the Netherlands and Germany we charge a general fee of 4,95 Euro. For orders over 100 Euro we charge a general fee of 0,00 Euro.
4.3 For orders within Belgium and Austria we charge a general fee of 8,95 Euro. For orders over 100 Euro we charge a general fee of 3,95 Euro.
4.4 For orders within other European Union Countries we charge a general fee of 11,95 Euro. For orders over 100 Euro we charge a general fee of 6,95 Euro.

5. Delivery
5.1 We deliver to the following countries (Member states of the EU): Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom.
5.2 Delivery time approximately 10 days within the Netherlands, Germany, Belgium and Austria. Delivery in other EU countries approximately 14 days. 
5.3 If delivery of ordered goods proves to be impossible, TopParfumerie will make an appropriate effort, in accordance with the requirements of reasonableness and fairness, to make substitute goods available. No later than at the time of delivery, TopParfumerie will notify the Buyer in clear and comprehensible terms that substitute goods are being delivered. If substitute goods are made available, the costs of return shipment are at TopParfumerie’s expense.
5.4 The delivery time stated is indicative and not to be regarded as a strict deadline, unless expressly otherwise agreed. If the delivery period is exceeded and if this is attributable to TopParfumerie, notice of default is required in each case. In the case of a late delivery which is attributable to TopParfumerie, the Buyer cannot derive any right to damages or to cancellation or termination of the contract if the delivery time is exceeded by no more than thirty (30) days.
5.5 If TopParfumerie fails to deliver on time, the Buyer may only cancel or terminate the contract insofar as it is necessary. Advance payments will be refunded in such a case, but without payment of interest.
 
 
6. Payment Methods
6.1 You can pay in advance by bank transfer, by credit card, by iDEAL, by Giropay and by PayPal.
6.2 Your credit card will be charged immediately after placing your order.
6.3 Your bank account will be charged immediately after placing your order if you choose to pay via iDEAL, Giropay or Paypal.
 
 
7. Risk and Transmission of Ownership
7.1
The Buyer carries the risk of all direct and indirect damage that may occur to the goods as soon as they have been delivered in accordance with the contract.
7.2 TopParfumerie retains the ownership of all delivered goods until all the claims which it has on the Buyer in respect of the goods delivered or to be delivered to the Buyer pursuant to contracts, or which arise from failure on the part of the Buyer to fulfil such contracts, have been paid in full.

9. Storage and Accessibility of the contract
The contract´s content will be stored. You may store the general terms and conditions and readily look them up. For safety reasons your order´s data are not available via internet. We keep these data in confidence according to our privacy policy.
 
 
10. Claims and Warranty
10.1 No later than at delivery, the Buyer is obliged to inspect the goods for conformity with the contract. If they do not conform, he must inform TopParfumerie accordingly as soon as possible in writing, giving reasons, but in any case within seven (7) working days of the delivery, or as soon as possible after it was reasonably possible to establish the nonconformity. Failing this, all relevant claims will lapse.
10.2 A claim by the Buyer in respect of delivered goods also lapses if: 
a. the goods cannot (anymore) be identified as originating from TopParfumerie;
b. the defects (also) result from normal wear and tear or the incompetent or incorrect handling, use, storage or maintenance of the goods;
c. the Buyer has not immediately given TopParfumerie the opportunity to investigate the claims and fulfil its obligations;
d. the Buyer has not fulfilled an obligation to which he is subject, or has not fulfilled it on time or properly.
10.3 If it is demonstrated that the goods do not conform to the contract, TopParfumerie has the choice between repairing the goods, making a new delivery or crediting the Buyer for the faulty goods. These General Terms apply in full in the event of a new delivery.
 
 
11. Liability
11.1 TopParfumerie is not liable for any misunderstandings, mutilation of data, delays or the defective transmission of orders or communications resulting from the use of the internet or any other communication channels used in the traffic between TopParfumerie and the Buyer or between TopParfumerie and any third parties, in so far as these misunderstandings etc. relate to the relationship between TopParfumerie and the Buyer,unless, and to the extent that, TopParfumerie is culpable of gross negligence or acted with intent.
11.2 TopParfumerie’s liability in no case extends to trading loss or any other indirect loss or damage.
11.3 Except in the case of intent or gross negligence, TopParfumerie is not liable for any direct or indirect loss or damage resulting from the infringement of intellectual or industrial property rights, licenses or other third-party rights.
11.4 The limitations of, and exclusions from, liability and indemnity stipulated for TopParfumerie in the above subclauses are also stipulated for its employees, all others who are engaged by TopParfumerie in the framework of the contract, and any parties from whom TopParfumerie buys delivered goods or parts.
 
 
12. Force Majeure
12.1 In these General Terms, force majeure means any shortcoming which is not attributable to TopParfumerie for the reason that it carries no blame for the shortcoming, and for which it is not responsible pursuant to the law, legal acts or common opinion.
12.2 If the contract cannot be performed on the grounds of force majeure, TopParfumerie is entitled, without judicial intervention being required, either to suspend performance of the contract for a period of no more than three (3) months or to terminate the contract partially or as a whole, by notifying the Buyer and without TopParfumerie being liable to pay any compensation, unless this should be unacceptable in the given circumstances according to criteria of reasonableness and fairness.
12.3 If TopParfumerie suspends performance of its obligations, it is entitled – and, at the end of the suspension period, obliged – to choose between performance or the full or partial termination of the contract.
 
 
13. Applicable Law
Dutch law applies to the contract, including these General Terms and any further contracts deriving from, consequential to, or related to the contract.
